Needham Boards Briefed on New Variance Standard

Needham's Planning Board and Zoning Board of Appeals got a joint legal briefing on state zoning changes that ease the path to a variance. Town Counsel Chris Heap told members led by Planning Board Chair Justin McCullen and Zoning Board member Howard Goldman that Massachusetts General Laws Chapter 40A now requires a variance whenever strict enforcement "would result in a practical difficulty," replacing a standard he called "probably the most difficult relief to obtain." Member Oscar Mertz asked whether the law could support converting a single-family lot to a two-family use; Heap said yes, though the board is not compelled to grant it. Variances now last up to four years with extensions, and non-conforming structures can expand by right without board review if they meet height and setback limits, a change Heap said could interact awkwardly with Needham's separate plan to lower large-house size limits at Town Meeting.
Both boards voted unanimously to adjourn.
