Needham tree panel resolves bylaw conflicts with town counsel

Needham's Tree Preservation Planning Committee spent Monday's snowbound session working through legal conflicts in its draft tree bylaw with Town Counsel Chris Heap, settling on a $300-per-day fine for violations and confirming the town cannot withhold building permits to enforce it. Heap said the bylaw, since it is a general bylaw rather than a zoning bylaw, "would not be able to deny a building permit for the proposed construction" over noncompliance, pointing instead to the town's Section 8 fine schedule. Members, including Kurt Petrini and Erica Hitchings, also discussed how bonds for future tree planting should be handled if a property sells, small-lot exemptions for utilities, and whether the bylaw should regulate new subdivisions, which Heap said must instead go through the Planning Board.
No bylaw language was formally voted on; the committee adjourned 6-0 and plans a public forum in late March.
